Trademarks are anything that can be considered a characteristic to make an item stand out and describe it in some way as different from others. The power of Congress gives authority for the use of trademarks in commerce. Many businesses and products use trademarks specific to the product. For instance, a store may use the initials of their store as their trademark, which would be an obvious sign and one, which consumers would come to recognize as pertaining to the store. Trademarks may also include drawings or markings of some kind. Applications for trademarks may be filed directly via the internet; however, trademarks do not have to be registered. Even with the use of a trademark, others can make or use the same goods or services; however, they must be displayed with a completely different mark.
