Product Patent Licensing and Infringement
A product patent is a legal right which is given exclusively to an individual or business entity to use an invented product for a proscribed period of time.
Patent Licensing Infringement
A patent is issued pursuant to a legal document which provides the exclusive legal ownership to the invention. Once this patent is issued, other individuals may not use, take, reproduce or sell the invention unless the patent holder has given the individuals permission to do so. If another person or entity uses the patent without permission, that person or entity commits product patent infringement and is liable for such activity.
What is Patent Licensing?
The owner of a patent may grant a license to another person as a product patent license. The person who receives the license is referred to as a “licensee.” The licensee is permitted to utilize the patent, subject to any restrictions the owner (also known as the licensor) has placed upon the license. Usually, there is a product licensing fee paid by the licensee to use the patent. In addition, the license may be exclusive or non-exclusive. In exclusive product licensing, the licensor agrees to give only one licensee the right to use the patent. On the other hand, if a license is non-exclusive, the licensor may grant unlimited patent licenses.
